These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

In no event shall Mend Packaging be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of our products. This product is meant for adults over the age of 18.
Mend Packaging reserves the right, in its sole discretion, to terminate your access to the site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the state of Maharashtra and you hereby consent to the
exclusive jurisdiction and venue of courts in Maharashtra in all disputes arising out of or relating to the use of the site. Use of the site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Mend Packaging as a result of this agreement or use of the site. Mend Packaging’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Mend Packaging’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the site or information provided to or gathered by Mend Packaging with respect to such use. If any part of this agreement is determined to be invalid or unenforceable
pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Mend Packaging with respect to the site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Mend Packaging with respect to the site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
If a dispute should arise between you and Mend Packaging, we want to provide you with a resolution that is efficient and cost effective by using our customer service team. Almost all customer service disputes can be resolved by sending an email to contact@themendpackaging.com.
If the dispute cannot be resolved by Mend Packaging’s customer service team, you agree that the dispute shall be referred to a sole arbitrator to be mutually appointed by you and Mend Packaging. You agree that the arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 and the
laws of India shall be applicable to the same. You agree that the seat of the arbitration shall be Hyderabad, India and the language of such proceedings shall be English. The courts of Hyderabad, India shall have exclusive jurisdiction over all disputes arising out of the present Agreement.
The provisions of this Agreement are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to
render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by Mend Packaging, or alternatively, by disposition of an arbitrator or a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised f rom the Agreement without affecting the validity, legality or enforceability of any of the remaining provisions.
No waiver of any term of the Agreement shall be deemed a further or continuing waiver of such term or any other term, and Mend Packaging’s failure to assert any right or provision under the Agreement shall not constitute a waiver of such right or provision.
